By downloading, installing, or using the ArtMuse mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

ArtMuse is an AI-powered photo editing application that allows users to:

Edit photos using voice commands and text input
Apply AI-powered filters and effects
Remove objects and replace backgrounds
Share content to social media platforms
Access premium features through subscription

3. App Usage and Requirements

3.1 No Account Required

ArtMuse operates without requiring user account creation
No personal information is stored on our servers
All editing and data processing happens locally on your device
We do not collect or retain account data according to our privacy-first approach

3.2 Eligible Users

You must be at least 13 years old to use the App
Users under 18 must have parental consent
You must comply with all local laws and regulations

4. Subscription Services

4.1 ArtMuse Pro

Pro subscription provides additional features and increased usage limits
Subscription fees are charged through Apple's App Store
Subscriptions automatically renew unless cancelled 24 hours before renewal

4.2 Free Tier

Free users receive limited monthly AI editing credits
Additional usage requires subscription upgrade

                4.3 Billing and Refunds
                All billing is handled by Apple App Store
Refund requests must be made through Apple
We do not provide direct refunds

            

5. Acceptable Use Policy

5.1 Permitted Uses

Create and edit your own photos
Share content you have legal rights to modify
Use the App for personal, creative, or commercial purposes

5.2 Prohibited Uses

You may NOT use the App to:

Edit content you don't own or have permission to modify
Create harmful, illegal, or offensive content
Infringe on others' intellectual property rights
Attempt to reverse engineer or hack the App
Create deepfakes or misleading content of real people without consent
Violate any local, state, or federal laws

6. Content and Intellectual Property

6.1 Your Content

You retain all rights to photos you edit
You are solely responsible for the content you create and share
We process your content locally on your device for editing purposes only
Your content is not stored on our servers or shared with third parties

6.2 Our Intellectual Property

The App, its features, and AI models are our proprietary technology
You may not copy, distribute, or create derivative works
ArtMuse trademarks and logos are protected

7. Privacy and Data Protection

Your privacy is our top priority
We operate on a privacy-first principle with no data collection

All data processing occurs locally on your device

8. Disclaimers and Limitations

8.1 Service Availability

We strive for high uptime but cannot guarantee 100% availability
Services may be temporarily unavailable for maintenance
AI processing results may vary and are not guaranteed

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES
OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE
WE PROVIDE THE APP "AS IS" WITHOUT WARRANTIES

9. Termination

9.1 By You

You may stop using the App at any time by deleting it from your device
Cancel subscriptions through Apple App Store
No account data will be retained as we do not store user accounts

9.2 By Us

We may restrict access to the App for:

Violation of these Terms
Fraudulent or illegal activity
Technical or security reasons

10. Updates and Changes

We may update the App to add features or fix issues
We may modify these Terms with notice through the App
Continued use constitutes acceptance of updates
